These Terms of Service (“Terms”) govern your access to and use of the Montana Title Assistance website and any information, assistance, coordination, products, or services offered through it (collectively, the “Services”).
By visiting the website, submitting a request, purchasing a service, or otherwise using the Services, you agree to these Terms, our Privacy Policy, and our Return, Refund, and Cancellation Policy.
If you do not agree, do not use the Services.
1. INDEPENDENT SERVICE PROVIDER
Montana Title Assistance is an independent service provider. We are not affiliated with, sponsored by, endorsed by, or part of the Montana Motor Vehicle Division, any county treasurer’s office, or any other government agency.
We do not issue titles, registrations, license plates, permits, or other government documents. Government agencies and independent third-party providers make their own decisions and determine their own requirements, fees, and processing times.
2. DESCRIPTION OF SERVICES
Depending on the service selected, we may:
• Review information supplied by you.
• Explain possible service options and general next steps.
• Help organize information and documents.
• Coordinate with independent registered agents, title or registration processors, county offices, government agencies, shipping providers, or other third-party service providers.
• Provide status updates based on information available to us.
The exact scope, price, and anticipated third-party costs will be explained before you purchase a paid service.
Submitting an initial contact form does not require you to purchase anything and does not create an attorney-client, accountant-client, fiduciary, agency, or government relationship.
3. NO LEGAL, TAX, OR FINANCIAL ADVICE
Information provided through the website or Services is general administrative and service-coordination information. It is not legal, tax, accounting, insurance, or financial advice.
Montana Title Assistance is not a law firm, accounting firm, insurance agency, vehicle dealer, government agency, or licensing authority.
You should consult an appropriately licensed professional concerning legal, tax, insurance, residency, business-registration, or regulatory questions.
4. NO GUARANTEE OF RESULTS
We do not guarantee:
• Approval of any title, registration, plate, permit, application, filing, or transaction.
• Eligibility for a particular registration, tax treatment, exemption, or business structure.
• A particular processing or completion date.
• Acceptance of documents by any government agency or third party.
• That laws, fees, forms, procedures, or agency requirements will remain unchanged.
Processing times and outcomes may be affected by government agencies, county offices, mail carriers, registered agents, third-party providers, incomplete records, changing requirements, or circumstances outside our control.
5. CUSTOMER ELIGIBILITY AND AUTHORITY
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase Services.
By using the Services, you represent that:
• You are the lawful owner of the vehicle or have valid authority from the owner to request assistance.
• All information and documents you provide are accurate, complete, current, authentic, and lawfully obtained.
• The requested service has a legitimate and lawful purpose.
• You will comply with applicable federal, state, local, and other laws.
• You will not use the Services to evade taxes, residency requirements, registration requirements, liens, judgments, emissions requirements, insurance requirements, law-enforcement action, or other legal obligations.
6. PROHIBITED USES
You may not use the website or Services to:
• Submit false, altered, stolen, forged, misleading, or fraudulent information or documents.
• Misrepresent ownership, residency, vehicle location, business activity, or eligibility.
• Conceal a lien, theft report, salvage status, ownership dispute, or other material fact.
• Commit fraud, identity theft, tax evasion, title washing, money laundering, or any other unlawful act.
• Interfere with the website’s security or operation.
• Introduce malware, attempt unauthorized access, scrape the website, or misuse another person’s information.
• Violate the rights of Montana Title Assistance, Shopify, another customer, a government agency, or any third party.
We may refuse, suspend, or terminate a request if we reasonably suspect unlawful activity, fraud, material inaccuracies, missing authority, or a violation of these Terms.
7. CUSTOMER INFORMATION AND DOCUMENTS
You are responsible for providing requested information and documents promptly.
Do not submit Social Security numbers, complete payment-card numbers, banking passwords, or unrelated sensitive information through the website’s general contact form.
You authorize us to use and disclose information reasonably necessary to evaluate, coordinate, and perform the requested Services, consistent with our Privacy Policy.
We may rely on the accuracy of information and documents you provide. We are not responsible for delays, denials, additional costs, or other consequences caused by inaccurate, incomplete, late, fraudulent, or missing information.
8. SERVICE ESTIMATES AND THIRD-PARTY COSTS
Any quote or estimate is based on information available at the time it is provided.
Government fees, taxes, postage, shipping, registered-agent fees, county charges, inspection expenses, and third-party processing costs may change or may not be known until a provider or agency reviews the matter.
We will attempt to notify you before incurring a material additional cost that was not included in the accepted service description. You may be required to approve and pay additional fees before work continues.
9. PAYMENTS
You agree to pay the prices and authorized third-party costs presented to you at the time of purchase.
Payments may be processed by Shopify or another payment provider. You represent that you are authorized to use the payment method submitted.
We may pause or decline Services if a payment is declined, reversed, disputed, or not received.
Refunds and cancellations are governed by our Return, Refund, and Cancellation Policy.
10. THIRD-PARTY PROVIDERS AND GOVERNMENT AGENCIES
Some Services may require coordination with independent providers or government agencies.
Those parties are not our employees and may have separate agreements, policies, eligibility requirements, fees, and processing procedures. We are not responsible for their independent acts, omissions, decisions, delays, system outages, policy changes, or errors.
A link, referral, or coordination arrangement does not constitute a guarantee or endorsement of a third party.
11. COMMUNICATIONS
By submitting your contact information, you authorize us to communicate with you about your inquiry, purchased Services, requested documents, payments, status updates, and related matters.
You are responsible for keeping your email address and other contact information current and for reviewing messages sent to you.
Consent to receive marketing communications is not required to purchase a service. You may unsubscribe from promotional emails, but you may still receive necessary non-promotional communications.
12. PRIVACY
Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy.
Because no internet or email transmission is completely secure, provide only the information reasonably necessary for the requested service.
13. WEBSITE INFORMATION
We attempt to keep website information accurate and current, but laws, forms, fees, policies, and government procedures may change without notice.
Website information is provided for general informational purposes and should be independently confirmed before you rely on it for an important decision.
14. INTELLECTUAL PROPERTY
The website and its original text, branding, graphics, logos, arrangement, and other content are owned by or licensed to Montana Title Assistance and are protected by applicable intellectual-property laws.
You may use the website only for personal, lawful purposes connected with evaluating or purchasing our Services. You may not reproduce, sell, exploit, republish, or commercially distribute our content without written permission.
15. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the website and Services are provided on an “as is” and “as available” basis.
We disclaim warranties that the website or Services will be uninterrupted, error-free, completely secure, suitable for every purpose, or result in approval by any government agency or third party.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Montana Title Assistance will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost opportunities, loss of use, or losses caused by agency or third-party delays.
To the fullest extent permitted by law, our total liability relating to a purchased service will not exceed the service fee you paid directly to Montana Title Assistance for the specific service giving rise to the claim.
This limitation does not apply where liability cannot legally be limited or excluded.
17. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold Montana Title Assistance harmless from claims, losses, penalties, costs, or expenses arising from:
• False, misleading, fraudulent, or unauthorized information or documents supplied by you.
• Your unlawful or prohibited use of the Services.
• Your violation of these Terms or another person’s rights.
• Taxes, penalties, registration obligations, or other legal duties that remain your responsibility.
This provision does not require you to indemnify us for conduct for which indemnification cannot legally be required.
18. SUSPENSION OR TERMINATION
We may refuse, suspend, or terminate access to the website or Services if:
• You violate these Terms.
• Required information or payment is not provided.
• We reasonably suspect fraud, unlawful conduct, safety concerns, or misuse.
• Continuing the service would violate a law, agency rule, provider requirement, or professional obligation.
• The requested service becomes unavailable or impracticable.
Any refund following termination will be determined under our Return, Refund, and Cancellation Policy and applicable law.
19. GOVERNING LAW
These Terms are governed by applicable United States law and the law of the state in which Montana Title Assistance is legally established, without limiting any consumer protection that applies to you and cannot legally be waived.
20. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be enforced to the maximum extent permitted by law.
21. NO WAIVER
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
22. ENTIRE AGREEMENT
These Terms, the Privacy Policy, the Return, Refund, and Cancellation Policy, and any written service description accepted at purchase constitute the agreement between you and Montana Title Assistance regarding the Services.
23. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our Services, business practices, technology, or legal obligations.
Revised Terms will be posted with an updated “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
